The matter is taken up for hearing by way of praecipe dated 22.12.2022 filed by the Applicant seeking urgent relief.

Respondents Nos. 1 and 2 have not yet been served, but Respondent No. 3 who has been served, appears through counsel and seeks time to file a reply.

The office has reported that the service is not complete on this M.A. on the rest of the Respondents but the learned counsel appearing for the Applicant submits that the only party who is concerned with this application is the third Respondent who has already appeared. Therefore, the notice to the rest of the Respondents may be dispensed with.

The prayer is allowed as it appears reasonable that no time need be wasted on service of notice on the rest of Respondents who

are not concerned with the prayer in this application for withdrawal of pre-deposited under Sec. 21 of the RDB Act. However, the third Respondent who has deposited the amount seeks time to file a reply.
