After scrutiny it is found that all the parties in MA/913/2019 as annexed at annexure K of Volume II of memorandum of appeal are not arrayed in this Misc. Appeal Dy. No. 606 of 2023.

In response of the query raised by the registry Ld. Counsel Mr. Aritra Deb appeared and submits one affidavit dated 15/09/2023 wherein it has been stated that the instant appeal is filed by the Indo Wagon Engineering Limited as being the Intervener and Jessop & Co. Ltd, United Bank of India, Bank of India were arrayed as respondents, whereas Edelweiss Asset Reconstruction Company was arrayed as the Applicant to the said proceedings.

It is also stated that in the instant appeal the reliefs sought by the Edelweiss Asset Reconstruction Company, i.e., the Appellant herein are only with respect to the Indo Wagon Engineering Limited. However, in the event if this Hon’ble Appellate Tribunal directs impleading of other parties the Appellant shall do so in compliance of such direction of the Appellate Tribunal in future.
