THE APPELLATE TRIBUNAL :
Order dated 3rd July, 2023 regarding pre- deposit was challenged before the Hon’ble Calcutta High Court in C.O. No. 2494 of 2023 which was allowed on 24.08.2023 and the order was modified to an extent that Appellant was permitted to make a deposit of 35% of Rs. 3,88,67,695/-. As per the Registry note dated 18.09.2023 amount of Rs.1,36,03,694/- is deposited on 14.09.2023 in compliance of the orders of the Hon’ble Calcutta High Court. Accordingly, let the Appeal be listed as a regular appeal by providing a regular appeal number.

I.A. No. 367 of 2023 filed by one Sukhani Europhil Ltd. and Gemus Merchants Pvt. Ltd. for being impleaded as a Respondent in the Appeal. Copies are served upon Appellants as well as the Respondents who may file the opposition within four weeks with copy to the Appellant who may file the rejoinder if any, within two weeks thereafter.
List on 19th January, 2024 for disposal of I.A. No. 367 of 2023. In the meantime, Respondents may file the opposition to the main Appeal within four weeks with copy to the Appellant who may file the rejoinder within four weeks thereafter.
