This application is filed seeking refund of statutory deposit made as per orders of this Tribunal dated 24.9.2021 in IA 303/2021 (Waiver), for entertaining the Appeal.
Heard both sides.
Advocate for petitioners/appellants submitted that Appeal MA(SA) 8/2022 was dismissed as ‘withdrawn’ on 18.4.2023 as matter was settled between parties and petitioners/ appellants are entitled for refund of statutory deposit.
Considering the reasons stated in the affidavit, application is allowed as prayed for and Registry shall refund the deposited amount with accrued interest, if any.
