The Appellant has come up in appeal aggrieved by the judgment dated 17.01.2014 in Appeal No. 06/2013 on the files of the Debts Recovery Tribunal-II, Mumbai (D.R.T) whereby the impugned order of the Recovery Officer dated 10.05.2013 in Recovery Proceeding (R.P.) No. 04/2006 was set aside and the matter was remanded to the Recovery Officer for fresh consideration.

The main dispute revolves around the claim put forth by the Appellant and the 1^st Respondent herein with regard to some movables valued at ₹ 12,00,000/-.

I find that it is only appropriate that the matter be sent back to the Recover Officer and the opportunity be given to both the contesting parties to agitate the issues before the Recovery Officer in Recovery Proceeding (R.P.) No. 04/2006 which shall be decided and disposed of within a period of two months from the date of receipt

of this order, untrammeled by whatever has been observed in the earlier order by the Recover Officer or by the Ld. Presiding Officer in Appeal No. 06/2013.
