Shri Ajit Kumar Chaurasiya, holding brief of Shri Namit Kumar Srivastava, Ld. Counsel for the appellant is present and submits D.D. No. 825191 dated 17.01.2023 (SBI) for Rs. 6300/- towards deficit court fee. Ld. Counsel files Dates and Events, affidavit in support of appeal. Ld. Counsel also provides pin code detail of fee in para 10 incorporated para 9 and corrected other defects. Defects reconciled. Proper court fee paid.
No pre deposit has been made. Waiver Application has been filed. As per the Demand Notice (page 41-42 of instant Appeal) dues as on 12.04.2020 was Rs. 15,43,963= 52 P + interest. It has been stated in the Waiver Application that as per Bank letter dated 16.12.2022 (Page 84 of the instant appeal) the amount of Rs. 22,67,163/- of the appellant is lying with Respondent-Bank. Ld. Counsel states that he will argue this issue before Hon’ble Court.
The instant Appeal has been filed under section 18 of the SARFAESI Act against final order dated 07.12.2022 of DRT, Lucknow in S.A. No. 572/2022. Urgency Application (I.A. No. 752/2022), Waiver Application (I.A. No. 751/2022), Stay Application (I.A. No. 750/2022) have been filed along with the Appeal.
