Heard the learned counsels for the parties.

Issue notices to the remaining respondents by two modes i.e. Registered Post with A.D. and Speed Post. Steps to be taken by the appellant within a week. Affidavit of service along with tracking report be filed by the next date.

Learned counsel for the appellant contends that the appellant is a borrower and has deposited a demand draft no. 512920 dated 24.01.2023 for Rs. 1,25,00,000/- towards pre-deposit for entertaining the appeal.

The amount deposited by the appellant be kept in the form of FDR in Nationalized Bank for a period of six months in auto renewal scheme.

Learned counsel for the appellant further contends that the property in question is a residential house, in which the appellant as well as his family resides and the appellant is ready to deposit the entire outstanding amount, as may be indicated by the respondent-Bank along with interest as per schedule to be given by the respondent-Bank. It is also contended that the appellant is ready to deposit Rs. 1.00 crore within 20 days, out of which Rs. 50.00 lacs within a week and rest Rs. 50.00 lacs within a week thereafter.
