Learned counsel for the appellant submits that the arguing counsel Shri Syed Fahim Ahmed is indisposed today, therefore, he is unable to appear before this Court, hence he seeks adjournment.
As against the demand notice for Rs. 20,93,482/-, the appellant has deposited Rs. 5.25 lacs vide demand draft no. 450566 dated 04.05.2023, which is 25% of the said demand. Let the said amount be kept in the shape of FDR in the nationalized Bank for a period of one year in auto renewal scheme.
Learned counsel for the respondent-Bank states that at present, the Bank is not going to take possession of the property in question and if the possession is to be taken, at least 7 days’ notice will be given to the appellant.
List this case on 25.05.2023 for hearing on the waiver of rest 25% of the amount due.
