The matter is taken up for hearing by way of a praecipe filed by the Appellants for seeking urgent relief.
- The Appellants are in appeal impugning the order dated 04.08.2023 dismissing the I.A. No. 2506/2023 in the Securitization Application (S.A.) No. 151/2023 on the files of the Debts Recovery Tribunal-I, Mumbai (D.R.T.) and declining to grant any interlocutory relief of protection to the Appellants with regard to the Sarfaesi measures initiated against the secured assets by the Respondent creditor. subsequent to the dismissal of the I.A., physical possession of the property has been taken and now I am told that the sale is scheduled to be held on the 23rd instant.
