The Appellant Bank has filed this appeal challenging the impugned order in Securitization Application (S.A.) No. 54/2020 on the files of the Debts Recovery Tribunal, Aurangabad (D.R.T.). There is a delay of 17 days in filing the appeal which is of the year 2021. The 1st Respondent has filed a reply stating that the reasons stated for condoning the delay are not sufficient.
After having heard the rival arguments and on going through the documents, I find that the delay of 17 days can be condoned on the payment of cost ₹5000/- to the paid by the Appellant Bank to the D.R.T., Bar Association, Mumbai within a week for the purchase of books and periodicals. Failing which the application shall stand dismissed.
Post on 18.09.2023 Before the Registrar for reporting compliance.
