The matter is taken up for hearing by way of Praecipe filed by the Appellants seeking urgent relief.
The Appellants had undertaken to deposit the pre-deposit amount of ₹ 3.61/- crores within a week on or before 28.12.2022. The Appellant could deposit the amount within that time. There was an ad-interim order of stay granted in favour of the Appellant.
The Appellants filed an application for an extension of time and on 29.12.2022 the order of stay was vacated. I.A. No. 3 of 2023 is filed for an extension of time and the time is extended and the Appellants are granted two weeks’ time to deposit ₹ 3.61/- crores as undertaken to be deposited.
Call for compliance. Failure to do so would entail in dismissal of the appeal. I.A. is allowed.
