The Appellants are in appeal impugning the order of the Debts Recovery Tribunal-II, Ahmedabad in the Securitisation Application (S.A.) No. 292/2021. The Appellants have already complied with the direction of this Tribunal to deposit the amount as directed under Sec.18 (1) of the SARFAESI Act.

In this application, 30 days of delay in filing the Appeal is sought to be condoned by the Appellants. They have detailed the reasons for the delay in filing the Appeal. Respondent appears and filed objections stating that there is no reason for condoning the delay.

After hearing both sides and on considering the sufficiency of the reasons stated in the application and the affidavit, I find that there are no reasons to decline the prayer for condoning the delay. The application is, therefore, allowed, and the delay of 39 days in filing the Appeal is condoned.

The Appeal shall be taken on file if there are no defects to be cured.
