I.A. No. 112/2023 is an application for condoning the delay in filing the application for bringing on record the legal representative of the deceased Respondent No.2.
The 3rd Respondent is the wife of Respondent No.2 who died on 15.06.2011.
The Appellant states that he was not aware of the demise of the 2nd Respondent and the death certificate of the deceased could not be obtained and therefore, the delay. Notice has been served on the proposed legal heirs as well.
No objection is forthcoming.
Under the circumstances, I find that the application for condonation of delay is only to be allowed and the application is allowed.
The application for bringing on record the legal representative shall be taken on file if there are no other defects to be cured.
Post on 09.06.2023 before the Registrar.
