Heard the learned counsel for the applicant on the application for release of amount.
Learned counsel for the applicant contends that the appeal has already been decided by this Tribunal vide order dated 31.10.2019. Further, the said appeal was partly allowed and the matter was remanded back to the Tribunal below to decide the S.A. afresh only to the extent of issue pointed out in the remand order. It is also submitted that an amount of Rs. 23.00 lacs was deposited by the appellant towards predeposit for maintaining the appeal, which is still lying with this Tribunal. It is, therefore, prayed that the same may be released in favour of the applicant at the earliest.
In view of the above, the application is allowed and the aforesaid amount along with interest accrued thereupon is directed to be released in favour of the applicant within fortnight from today, if there is no other legal impediment in the issue.
