Shri Deepak Maurya, holding brief of Shri Udai Chandani, Ld. Counsel for the appellant is present and files affidavit in support of Stay Application, and also provide details of fee in Para 10 of the Appeal.
As regards pre-deposit, Ld. Counsel states that order challenged is interim order and S.A. is pending. Ld. Counsel undertakes that he will file Waiver Application before Hon’ble Court tomorrow and prays to list the case before Hon’ble Court tomorrow in view of Urgency.
The instant Appeal has been filed under section 18 of the SARFAESI Act against interim order dated 30.01.2023 passed by DRT, Allahabad in S.A. No. 296/2020. Appellant has also filed Expedite Application being I.A. No. 121/2023 and a Stay Application being I.A. No. 122/2023.
