As per demand notice the amount of dues Rs. 17,59,045= 50 P+ Interest (page 62 of the appeal). It has been stated in the Waiver Application that respondent-Bank sold the property in auction for Rs. 15.57 lakhs. (Sale certificate at page 80 of appeal). Further the appellant had deposited Rs. 1,04000/- with Bank on 28.01.2021 and 26.03.2021. Page No. 47 and 48 of the appeal. Ld. Counsel states that he will argue before the Hon’ble Court.
The instant Appeal has been filed under section 18 of the SARFAESI Act against final order dated 09.09.2022 of DRT, Patna in S.A. No. 94/2021. Urgency Application (I.A. No. 428/2022) and Waiver Application (I.A. No. 429/2022) have been filed.
