Shri Vipul Pandey, Ld. Counsel for the appellant is present and submitted Non Judicial Stamp of Rs. 60/=. Ld. Counsel not pressed the pages pointed out by the registry as illegible Ld. Counsel mentioned Pin Code Number. Proper court fee already paid.
As regards delay, Ld. Counsel submits that Free Copy of the order was issued on 04.10.2022 and there is no delay. The impugned order is dated 03.8.2022. Free copy issued on 04.10.2022. The instant appeal filed on 01.11.2022. Hence, the defect reconciled.
No pre deposit has been made. Waiver Application has been filed. As per the Demand Notice the dues of Bank was Rs. 18,45,04,383.=54P as on 16.10.2018 with interest (Page No. 38 of the instant appeal). It has been mentioned that the property has been sold by Bank. Ld. Counsel states that he will argue before the Hon’ble Court.
The instant Application has been filed under section 18 of the SARFAESI Act against final order dated 03.08.2022 of DRT, Lucknow in S.A. No. 290/2019. Waiver Application (I.A. No. 532/2022) has been filed.
