Suhas Abhimanyu Shinde versus the Authorised Office, Muslim Co-Operative Bank

This Tribunal had on 11.08.2022, without entering into the merits, directed the Appellant, who was conducting business in the subject premises before he was dispossessed, to make an offer to the Respondent Bank, to negotiate the matter amicably, and had requested the first Respondent to consider the offer, if it was found viable. Accordingly, the Appellant sent the notice on 29.08.2022 to the Respondent Bank. A reply received from the Respondent to that letter is placed before this Tribunal. The tenor in the reply is in total disregard of the order made by this Tribunal requesting the Respondent Bank to be receptive to any offer made by the Appellant. Unfortunately, the Respondent Bank is still clinging to the impugned order of the Ld. Presiding Officer in the S.A. which stands challenged before this Court. The Bank has not at all considered the directions given by the Tribunal in the order dated 11.08.2022. This would attempt to contempt. The officer of the Respondent Bank

would be called upon to answer to this contempt.

The Ld. Counsel appearing for the Respondent Bank fairly submits that he requires some more time to get instructions from his client. And hence, I restrain myself from embarking upon any stringent action for the meanwhile.

The interim order regarding the status quo shall continue till the next date of hearing.
