This application is filed to condone delay of 72 days in preferring the appeal.
Notice to respondent is published and in spite of paper publication, respondent neither appeared in person nor through any advocate.
Advocate for petitioner/appellant bank submitted that delay is during COVID pandemic period and as per judgment of Hon’ble Supreme Court of India, period from 15.3.2020 to 2.10.2021 stands excluded and as the present case is filed during that period, delay may be condoned.
Considering the judgment of Hon’ble Supreme Court of India and affidavit filed in support of the petition, delay is condoned and application is allowed.
Office to register the appeal, if it is otherwise in order.
