THE APPELLATE TRIBUNAL :
I.A. 377 of 2019 is an application for waiver from making pre-deposit. Learned counsel for appellant submits that respondent bank has filed O.A. for realization of dues at Rs.68.00 lakhs, however, O.A. was allowed to the extent of Rs.53.92 lakhs. Initially O.A. was allowed but subsequently the matter was remanded for hearing afresh, thereafter, impugned order was passed. In the meantime, as per judgement delivered by learned DRT in Para 15 of the judgement bank has recovered an amount of Rs.53 lakhs. This issue can be dealt with at the time of final hearing when balance predeposit is given.
