The O.A. was disposed of by the learned Presiding Officer stating that the evidence regarding hypothecation of the movable property has not been produced by the Appellant bank.
The learned counsel appearing for the Appellant submits that the details regarding hypothecation materials have been produced and copy pertaining to that evidence is also produced in the Appeal.
The facts of whether those materials have been produced before the lower forum are something to be ascertained and hence, called for the R & P from the D.R.T.-I, Mumbai.
