Advocate for respondents filed affidavits of undertaking that they will not encumber or create any charge over the subject property till disposal of this appeal.
Considering the affidavits, instead of taking stay application, i.e., IA 368/2022 , it is felt that main appeal itself can be taken up for hearing, for which both sides agreed.
Therefore, post the appeal for final hearing on 13.10.2022. Appellant shall deliver possession of the property as per direction of DRT, Coimbatore without waiting for disposal of this appeal. Respondents shall file affidavits on receipt of possession that they will hand over possession back to appellant as and when directed.
