Perused the order dated 7^th of November, 2019 passed by the Hon’ble High Court at Calcutta in writ petition, being W.P. 13410 (W) of 2018 (UCO Bank -vs- The Hon’ble Debts Recovery Appellate Tribunal & Others) wherein the application under Section 5 of the limitation Act has been allowed. In the instant Misc. Application, the Appellant has made a prayer for restoration of the appeal along with a prayer to set aside the order dated 14^th June, 2018.

Learned Counsel for the Appellant prays for and is permitted not to press the prayer for setting the order dated 14^th June, 2018. However, in view of the order of the Hon’ble High Court condoning the delay, let the appeal be

registered as regular appeal retaining its assigned number, i.e. Appeal No. 317 of 2018.

Accordingly, Misc. Application No. 443 of 2019, stands disposed of.

Respondent prays for and is granted three weeks’ time to file counter-affidavit with advance copy to the Appellant; rejoinder, if any, be filed three weeks thereafter with advance copy to the Respondent.
