Learned counsel for Respondent Nos.1 and 2 is present. Reply has been filed on the application for condonation of delay as also on the other applications.
There is no representation for the Appellant for quite some time. On 16.03.2022 it was specifically directed that the Appellant’s counsel shall be present positively for the hearing as this matter is pending since 2008 before this Tribunal.
Today, when the matter was called up for hearing, neither the Appellant nor its counsel is present. I assume that the Appellant is not keen on proceeding with the matter. Hence, the application for condonation of delay and all other Miscellaneous Applications along with the Appeal is dismissed for default.
