This is an application filed under Order 1 Rule 10 of CPC, 1908 filed by M/s S.P. Construction for impleadment as party in the present appeal.
Ld. Counsel for applicant herein states that he was declared as successful bidder in the auction of the property in question conducted by the appellant bank i.e. Indian bank and deposited the auctioned amount and therefore prays that he may be allowed to be impleaded as a party in the present appeal.
Ld. Counsels for appellant Mr. Amit Kasera and respondents Mr. R.K. Salecha have no objection if the appellant is impleaded as a respondent. Accordingly, present application is allowed and auction purchaser is impleaded as respondent no.5 in the present appeal. Let the appellant file the amended memo of parties accordingly.
Let copy of the appeal be supplied to the Ld. Counsel for newly impleaded respondent no.5 today itself. Let reply to the main appeal be filed by the respondents within one week.
