The learned counsel appearing for the Respondent Bank submits that the secured assets have already been sold and possession of the property handed over to the auction purchaser. The amount due from the Appellant borrower has already been realized and the excess amount has already been refunded to the Appellant, hence nothing survives in the Appeal.
Today, the matter stands posted for hearing of the application for waiver of deposit for which learned counsel for the Appellant is not ready and she seeks further time for getting specific instructions from his client.
Reply, if any, to the application for waiver of deposit shall be filed within four weeks.
