Received an application under section 20 of Recovery of Debts due to Banks and Bankruptcy Act, 1993 presented by Ld. Advocate, Mr. Prasenjit Pal.
Scrutiny of the application reveals the followings:
The application has been filed on behalf of M/s. Anant Trading Company & Ors against the order dated 19/12/2019 passed in IA No. 553 of 2016 in O.A. No. 15 of 2014 in DRT-III, Kolkata. Application fees of Rs.255/- vide T.R. No.116465 dt. 09.12.2022 has been paid along with the application.
In respect of order dated 07.11.2022 of Hon’ble High Court at Calcutta in revisional application being CO No. 644 of 2020 (copy annexed to Vol. II of Appeal Memo at Page No. 106107), challenging the order dated 19/12/2019 in O.A. No. 15 of 2014 of DRT-III, Kolkata, petitioner has been granted liberty to approach before Debt Recovery Appellate Tribunal (DRAT) within 30 days from the date of receipt of the order. Ld Advocate for appellant submits at page 3 of Limitation that the appellant downloaded the copy of such order from website of the Hon’ble High Court on 10/11/2022 and the instant appeal is being filed within the 30 days period from date of receipt of order.
The Vakalatnama has been filed by the Ld. Advocate.
The case is under the jurisdiction of this Appellate Tribunal.
Application is within the period of limitation.
This appeal is filed on behalf of proprietorship firm & 2 Ors. There is no signature in the capacity of proprietorship firm. Though second applicant is the proprietor of the firm and the application is signed by Appellant No. 2 & 3.
