THE APPELLATE TRIBUNAL :
Matter is taken up in the second round but no one is present for the Appellant.
I have gone through the judgment, dated 17th August, 2018, passed in W.P. 36100 of 2017 by the Hon’ble High Court at Hyderabad.
From the judgment it transpires that the Hon’ble Court has held that there is a delay of only four days in preferring the present appeal.
Having gone through the record of the case and upon hearing the Learned Counsel for Respondent Bank, I find that delay in filing the appeal has sufficiently been explained. Accordingly the delay in filing the appeal is hereby condoned.
Appeal be registered as regular appeal.

Learned Counsel for Respondent Bank seeks leave to file counter-affidavit.
Leave granted.
Counter affidavit be filed within three weeks; advance copy whereof be served upon the Appellant; rejoinder, if any, be filed before the next date with advance copy to the Respondent Bank.
