Present: Shri R. G. Goswami, counsel for the appellant, Shri Maneesh Mehrotra, counsel for the respondent-Bank,
Learned counsel for the appellant states that the present appeal has been filed against the interlocutory order, therefore, no amount is required to be deposited towards pre-deposit. The said argument of the appellant has vehemently been opposed and has referred to the earlier order dated 18.08.2021, whereby the appellant was directed to deposit at least 25% of the determined amount in furtherance of the order dated 04.09.2021, failing which the appeal would not be entertained further.
The office report dated 31.03.2022 reveals that no amount has been deposited till date.
In view of the above, the learned counsel for the appellant may comply with the order dated 04.09.2021 by the next date. If the appellant does not comply with the said order within the stipulated period, the appeal shall stand automatically dismissed without reference to the court.
