Shri Ramesh Singh, Advocate holding brief of Shri Vivek Kumar Singh, Ld. Counsel for the appellant appears and provides Dates and Events and Waiver Application. As such the defect No. 3 is removed, but the defect No. 2 shall stand, because appellant has not deposited any amount towards mandatory pre-deposit of 25%. In this regard the Ld. Counsel for the appellant submits that the present appeal has been filed against an interim order, therefore, no pre-deposit would attract for entertaining the appeal.
I do not agree with the submission of the Ld. Counsel for the appellant, since as per section 18, if any appeal is filed under the said section, the appellant has to deposit 50% of the amount due, out of which 25% is mandatory, which has not been deposited, but the Ld. Counsel states that he will argue the same before the Court.
The Ld. Counsel for the appellant further submits that there is urgency in the matter, therefore, the case be listed before the Hon’ble Court at the earliest, so he may argue on the waiver as well as interim relief.
As prayed, list this case for admission/pre-deposit on 20.05.2022.
