The order of the Registrar dated 20.04.2022 indicates that the delay occurred in filing the present appeal is covered by the judgment of the Hon’ble Apex Court in Suo Moto writ petition (C) No. 03/2020, therefore, the delay be condoned.
In view of the above, the delay is condoned.
The aforesaid order further indicates that no pre-deposit has been made. The waiver application has been filed along with memo of appeal on the ground that the property has been sold by the Bank. The learned counsel wants to argue on the waiver application. The said order also shows that the expedite, stay and waiver applications have been filed along with memo of appeal.
Let the notices be issued to the respondents on the expedite, stay and waiver applications by two modes i.e. registered post with A.D. and speed post. Steps to be taken by the appellant within a week.
