The Ld. Counsel appearing for the Appellants submits that the OTS proposal which has been filed by them has been accepted by the Respondent Bank.
The Ld. Counsel appearing for the Respondent Bank also submits that an OTS proposal is under consideration. Hence, the application for restoration is not opposed by the Respondent Bank. Only in case, the Appeal is restored could the OTS proposal be proceeded with.
Hence, M.A. No. 97/2019 is allowed and the Appeal No. 270/2009 is restored to file.
Post on 19.09.2022 for hearing.
