This matter has been taken up by me through Video Conferencing. Miscellaneous Application No.45 of 2022

The present application has been filed by the appellant bank for restoration of the appeal which was dismissed in default on 26.04.2022. The application is moved on the ground that the learned counsel could not able to join the proceedings of this Tribunal on 26.04.2022 due to technical glitch and network issue. The present application has been filed on 02.05.2022 i.e. within eight days from the date of dismissal.

Ld. Counsel for respondents submits that she has filed the reply today itself through email. She, however, submits that appellant bank’s counsel could have informed to the Court Master on that very day if he was not able to join the video conferencing, and prays that heavy cost may be imposed upon the appellant bank in case the present application is allowed.

Heard. Keeping in mind the fact that appellant bank’s counsel could not join the proceedings on 26.04.2022 due to technical glitch, the present miscellaneous application is allowed in the interest of justice. There shall be no order to cost. The appeal is thus restored back to its original number and stage.

Put up for 20.12.2022 for hearing on the application for condonation of delay and in appeal.
