Misc. Case No.21/2022
This is an application filed by the applicant/appellant for issuance of appropriate directions in terms of the order dated 24.02.2022 passed in CWP18110 of 2021 by the Hon’ble High Court of Punjab and Haryana High Court. A copy of the aforesaid order of the Hon’ble High Court has been placed on record and the last para of the same runs as under:-
“Since the claim of the petitioner is that he alone has deposited the amount required for filing the said appeal as a pre-deposit, and since the said fact is not disputed by respondents No.3 to 5, the order dt.15.01.2021 in Misc. Application No.1/2020 in Appeal No.276 of 2017 passed by Debts Recovery Appellate Tribunal, New Delhi is set aside; the said order is modified; and the petitioner alone is held entitled to the pre-deposit amount, and not his brother late Daljit Singh or his legal representatives.”
In the application, the applicant/appellant has made the following prayer:-
“a) Issue Appropriate Directions to the Registry of this Hon’ble Appellate Tribunal to release an amount of Rs.50,00,000/- along with accrued interest thereupon in favour of the Applicant herein in terms of order dated 24.02.2022 passed by the Hon’ble High Court of Punjab and Haryana;”
In view of the above, the application is allowed. Let the amount of Rs.50,00,000/- (Rs. Fifty Lacs only) which was deposited with this Tribunal towards pre-deposit be released to the applicant by the Registry within 07 days from today, along with accrued up-to-date interest.
The application is disposed of accordingly.
