This matter has been taken up by me through Video Conferencing.
Learned counsel for the appellant bank submits that the learned DRT has disposed of the S.A. vide its order dated 05.07.2022 and the appellant intends to file a fresh appeal against the said order. In view of the above development, Ld. counsel states, the appellant bank does not wish to pursue the present appeal filed against an interim order in the aforesaid S.A. and the same may be dismissed as withdrawn with liberty to the appellant to take all the pleas taken in the present appeal in the fresh appeal as well. Liberty is also sought to file and refer to the documents relied upon by the appellant in the present appeal.
The learned counsel for the respondents has no objection to the withdrawing of the appeal.
In view of above, the appeal is dismissed as withdrawn with liberty as prayed for.
The date of 28.09.2022 fixed in the present appeal stands cancelled.
