The Appellants were granted time by the Hon’ble High Court of Judicature at Bombay, Nagpur Bench, Nagpur to deposit the second installment of the pre-deposit ordered to be paid, within a period of two weeks from 27.06.2022 and the said period two weeks ends on 11.07.2022. Admittedly, the Appellants have not paid that amount. Since the order passed by the Hon’ble High Court was a conditional one, and it is specifically provided that if the condition is not complied with, the W.P. shall be dismissed without reference to the Hon’ble Court. The amount has not been paid yet. This Tribunal’s order dated 13.06.2022 is also a self-working order wherein it is observed that default in payment of any of the instalments on time would entail in the Appeal being dismissed automatically. Default in paying the amount even within the extended time granted by the Hon’ble High Court would therefore

result in dismissal of the Appeal. Hence, the Appeal stands dismissed.
