This application is filed seeking condonation of delay in depositing first and second instalments of pre-deposit as per order of this Tribunal dated 13.9.2021 in IA No.46/2021 (waiver).
It is represented that money is deposited, but, it is deposited with a delay of one day for first instalment and 7 days for second instalment due to COVID restrictions.
Advocate for respondent bank filed counter and objected this application.
On a scrutiny of contentions and rival contentions, I am of the view that objections of respondent bank are not tenable.
For the reasons stated in the affidavit filed in support of petition, delay as prayed is condoned and IA 177/2022 is allowed.
Registry to number the appeal, if it is otherwise in order.
