This matter has been taken up by me through Video conferencing.
This appeal has been filed by the appellant against the order dated 11.10.2022 whereby the learned DRT has directed the respondent no.3 to execute sale deed in favour of respondents 1 and 2 on or before 30.11.2022 with prior intimation to the bank to collect the original sale deed after execution. The learned DRT has also directed respondent 1 and 2 to amicably settle the matter with the bank during the intervening period, failing which liberty has been granted to the bank to proceed for taking physical possession and auction sale of the property. In the meantime, taking over of the physical possession has been stayed while listing the mater for 06.12.2022 for further proceedings.
The learned counsel for the appellant prays stay of the impugned order.
Heard. Issue notice to respondents for 30.11.2022. Till then execution of sale deed in favour of respondents 1 and 2 is stayed.
