This Application is filed seeking condonation of delay of 46 days in preferring the Appeal against impugned Order dated 30.07.2021.
Advocate for Petitioner/Appellant Bank submitted that delay is due to reasons stated in Affidavit and it is not intentional.
On the other hand, Advocate for Respondent Nos.1 & 2 submitted that borrowers have also filed an Appeal, and when borrowers’ Appeal is decided, there is no requirement of separate Order for Bank, as rights of parties would be determined in the Appeal filed by borrowers. However, as Bank also wants to challenge the impugned Order by way of an Appeal, no prejudice will be caused to Respondents, if an opportunity is given to Bank.
Considering reasons stated in the Affidavit filed in support of Petition, delay of 46 days in filing Appeal is condoned. IA 632/2021 is allowed.
