Miscellaneous Appeal No. 08/2020
This is an appeal filed by the appellant bank to set aside the order dated 18.09.2019 whereby Ld. DRT-III, Delhi had restrained the bank from taking physical possession of the property in question.
Ld. Counsel for appellant bank states that his prayer in the present appeal will stand satisfied if a direction is issued by this Tribunal to the Ld. DRT-I, Delhi to dispose of S.A. No. 228/2019 (now TSA No. 551/2022) in a time bound manner and liberty is given to the appellant to agitate all his contentions before Ld. DRT. The Ld. Counsel for appellant has further informed that next date of hearing before Ld. DRT is 26.12.2022.
Ld. Counsel for respondents no.1 and 2 has no objection to the above submission of Ld. Counsel for the appellant.
Heard. Let Ld. PO, DRT-I, Delhi take up the matter on 26.12.2022, and if it is not possible to take up the matter on the said date, then to take it up immediately thereafter, and dispose of the same as expeditiously as possible preferably within a period of four months.
With the above direction, the present appeal stands disposed of.
