When the matter is called during call work, advocate for first appellant represented that a Memo is already filed with regard to steps against deceased Appellant No.4. This Tribunal requested appellant counsel to give the date, on which, such a memo is filed and he sought permission to verify case bundle to answer the same. Accordingly, advocate for appellant was allowed to verify case bundle and matter was passed over.
When the matter is called again, neither appellant counsel is present nor any representation is made on behalf of appellant counsel. According to Office, no such memo is available in case bundle.
In view of the same, as steps are not taken against deceased appellant No.4, appeal of appellant No.4 is dismissed as abated.
