This matter has been taken up by me through Video Conferencing.
This appeal has arisen out of an order dated 22.8.2022 passed by the learned DRT-I, Delhi restraining the appellant FI from taking physical possession of the property in question. Learned counsel for the appellants states that huge amount of more than Rs.5 crores is to be recovered from the respondent and his prayer in the appeal will stand satisfied if the learned DRT is directed to dispose of the S.A. in question as expeditiously as possible and preferably within a period of three months.
Learned counsel for the respondent has no objection to the prayer being made by the learned counsel for the appellant for expeditious disposal of the S.A. by the learned DRT.
In view of above, the learned DRT-I, Delhi is requested to take up the S.A. (NDN 1167/2022) on 30.01.2023, and if not possible to take up the same on the said date, then to take it up immediately thereafter, and dispose of the same as expeditiously as possible, preferably within a period of three months. Parties are directed to appear before the learned DRT on 30.01.2023.
With the above direction, the appeal is disposed of.
