This Misc. Appeal is filed challenging the impugned order dated 13.02.2013 dismissing M.A. No. 25/2012, i.e. an application filed for condonation of delay in filing application for setting aside the exparte judgment dated 26.08.2010 in O.A. No. 15/2010 on the file of D.R.T., Nagpur.
The learned counsel appearing for Appellant was heard and he has relied upon a decision of the Hon’ble High Court of Bombay in Nandu D. Chhabria Vs. State Bank of India & Ors. [2012 (5) Bom CR 791] which is to the point and states that the delay can be condoned.
The learned counsel who is representing the counsel for the Respondent No.1 submits that the arguing counsel is not present and seeks adjournment. He submits that the reply has been already filed.
Post on 23.06.2022 for hearing.
There shall be no further adjournment.
