Ld. Counsel for appellant states that he had filed the present appeal against the order of Ld. DRT whereby auction was set aside. However, since the sale amount has already been returned to the auction purchaser, he therefore withdraws the present appeal with a liberty to issue a fresh auction notice in accordance with law.
In view of the above, present appeal is disposed of as withdrawn with liberty as prayed for.
