The matter is taken up for hearing by way of Praecipe dated 28.06.2022 filed by Appellants for seeking urgent relief.
The learned counsel for Respondent No.1 and 2 seeks time to file a reply to M.A. It is seen that Respondent No.3 has not been served.
Respondent No.3 is the mortgagor and is an essential party in this proceeding, therefore, the Appellant shall take immediate steps for complete service of notice on Respondent No.3.
The Appellants shall also cure the defects pointed by the Registry on or before the next date.
The matter shall be posted thereafter for filing Service Affidavit / reply hearing on 15.07.2022.
