Heard the learned counsels for the parties on the urgency application being I.A. No. 614/2022.
It is stated in the urgency application that the auction purchaser is trying to shift the plant and machinery from the factory premises, which has been purchased by him in the auction sale.
Learned counsel for the respondent-Bank submits that as the auction has been held and the possession has been handed over to the auction purchaser, he is not aware about the activities of the auction purchaser. Accordingly, the auction purchaser is required to be noticed by the next date.
Issue notice to the respondent-Auction Purchaser on the urgency as well as the appeal by two modes i.e. Registered Post with A.D. and Speed Post. Steps to be taken by the appellant within three days. Affidavit of service along with tracking report be filed by the next date.
