No. 007281 dated 19.09.2022 of Rs. 31,000/(Axis Bank) (Rupees Thirty One Thousands only), D.D. No. 007304 dated 29.09.2022 of Rs. 24,000/- (Rupees Twenty Four Thousands only) (Axis Bank) and D.D. No. 007305 dated 29.09.2022 of Rs. 1,500/- (Rupees One Thousands Five Hundred only) (Axis Bank) towards deficient court fees.
No pre deposit has been made. Waiver Application has been filed. As per the Demand Notice dated 11.08.2014 ( page 98 to 104 of instant Appeal) dues was Rs. 1,67,82,186=00 + Interest. Further, as per Auction Sale Notice published on 31.12.2015 ( page 167 of instant Appeal) dues was Rs. 2,65,83,829=00. It has been stated in the Waiver Application that an amount of Rs. 2,70,00,000=00 has already been realized from auction of the property. Counsel states that Counsel states that he will argue before the Hon’ble Court.
The instant Appeal has been filed under section 18 of the SARFAESI Act against final order dated 24.06.2022 of DRT, Jabalpur in S.A. No. 138/2017. Waiver Application (I.A. No. 455/2022), Stay Application (I.A. No. 362/2022), Delay Condonation Application (I.A. No. 363/2022) have been filed.
