Shri Avinash Kumar, holding brief of Shri Sandeep Arora, Ld. Counsel files his Vakalatnama on behalf of the Respondent-Bank.
No pre-deposit has been made. Waiver Application has been filed. It has been stated in the Waiver Application that the appellant deposited Rs. 1575710/- with Recovery Officer DRT, Allahabad in pursuance of demand notice and it has also been stated that Bank recovered Rs. 4471000/- from auction. Ld. Counsel states that he will argue this point before Hon’ble Court.
The instant Appeal is filed under section 18 of the SARFAESI Act against final order dated 06.08.2022 of DRT, Allahabad in S. A. No. 221 of 2020. Waiver Application (I.A. No. 294/2022) and Urgency Application (I.A. No.293/2022) have been filed along with appeal.
A Caveat Application (No. 44/2022) has also been filed in the instant case. Shri Sanjay Gupta, Ld. Counsel for the appellant states that he has supplied by e-mail a copy of the appeal to Shri Raj Kumar Tiwari, Ld. Counsel for the Caveator and has filed a proof in this regard.
