Heard the learned counsel for the appellants.

The present appeal has been filed under section 18 of the SARFAESI Act against the interim order dated 19.09.2022 passed by the DRT, Lucknow in S.A. No. 375/2020.

The report of the Registrar dated 16.11.2022 shows that the I.A. No. 574/2022 being urgency application has been filed.

Since the matter has been taken-up, the I.A. No. 574/2022 which is urgency application, has become infructuous and is disposed off as such.

The present appeal has been filed against the order dated 19.09.2022, whereby the auction purchaser has been directed to maintain the status quo in respect of movable and immovable property. The order impugned records that the Bank has auctioned the property and has given possession of the same to the auction purchaser, who is removing the articles and the property has been sold at an undervalued price. The Tribunal below has only directed to maintain the status quo, restraining the auction purchaser in respect of movable and immovable property.

After hearing the learned counsel for the appellant, this Tribunal is of the opinion that in case the appellant has any grievance with regard to grant of interim relief, he may file appropriate application before the Tribunal below, if so desired.

Accordingly, the appeal stands disposed off.
