Present: Shri A. K. Srivastava, counsel for the appellant,
Shri Maneesh Mehrotra, Advocate has put in appearance on behalf of the respondent-Bank, who prays for time to file reply, which is allowed.
Learned counsel for the appellant submits that the respondent no. 4 is a proforma party, therefore, the service of notice upon the respondent no. 4 be dispensed with. Ordered accordingly.
Learned counsel for the appellant submits that he has moved an application for impleading the auction purchaser, who is necessary party in the case.
The impleadment application is allowed and necessary amendment in the array of party of the memo of appeal be made immediately.
Issue notices to all the respondents except the respondent nos. 1 & 4 by two modes i.e. Registered Post with A.D. and Speed Post. Steps to be taken by the appellant within a week. Affidavit of service along with tracking report be filed by the next date.
List this case on 08.09.2022 for service.
